1. Who these terms are between
These Terms and Conditions govern the supply of white-label yak chews ("Products") by YakChew ("we", "us") to a veterinary practice or other trade customer ("you"). Placing an order through this website means you accept these terms on behalf of your practice.
Products are manufactured for us by The Mountain Pet Company in Kathmandu, Nepal. Your contract for supply is with us.
2. Trade customers only
We supply to veterinary practices, veterinary groups and comparable trade buyers for resale. We do not sell to consumers. By ordering you confirm you are acting in the course of a business and not as a consumer, and that consumer distance-selling cancellation rights do not apply.
3. Orders and minimums
Products are sold by the case. Each size has a production minimum, which is the case quantity:
- Small (33 g) — case of 25 chews
- Medium (70 g) — case of 12 chews
- Large (100 g) — case of 8 chews
- X-Large (143 g) — case of 6 chews
There is no combined minimum across sizes: a single case of a single size is a valid order. Quantities below a size's case minimum cannot be produced.
An order becomes binding when we confirm it in writing and you have approved your artwork proof under clause 4. Until then we may decline or adjust an order, for example where a price or stated specification was published in error.
4. Artwork, branding and approval
You supply the clinic name, and optionally a logo, to be printed on the wrapper. You confirm that you own or are licensed to use that name and logo, and that our printing it will not infringe anyone else's rights.
We prepare a wrapper proof and send it to you for approval, normally within two working days. Production does not begin until you approve the proof in writing. Once you approve it, the approved proof is the specification: we are not responsible for spelling, punctuation or logo errors present in artwork you signed off.
Plate and artwork setup is provided without charge on standard orders. We may decline artwork that is unlawful, misleading, or that makes veterinary or medical claims we cannot substantiate.
5. Production time
Products are made to order. Nothing is drawn from existing stock. Indicative production time is approximately four weeks from proof approval, plus transit.
This is deliberate. Because your practice's name appears on every wrapper, each batch is produced, cured and wrapped for your order rather than taken from inventory that may have been held for months. Production dates are estimates given in good faith and are not guaranteed delivery dates.
6. Pricing and payment
Prices shown on the website are wholesale, per case, exclusive of freight, duties and any applicable sales tax or VAT, which are added at invoice. Suggested retail prices are suggestions only; you set your own resale prices.
Payment is taken at checkout unless we have agreed credit terms with you in writing. Card payments will be processed by Stripe; we do not receive or store your full card details.
This website is currently a proof of concept. No payment is taken, no card details are transmitted, and no order placed here is sent to production.
7. Delivery and title
Freight is quoted at proof approval and charged separately unless otherwise agreed. Risk in the Products passes to you on delivery to the address you supply. Title passes when we have received payment in full.
Please inspect deliveries on arrival and tell us about shortages or visible damage within seven days of receipt.
8. Cancellation and changes
You may cancel or change an order without charge at any point before you approve the artwork proof.
After proof approval, the Products are personalised goods made to your specification and cannot be resold to anyone else. Orders cancelled after approval may be charged in full or in part depending on how far production has progressed. Contact us as early as possible and we will do what we reasonably can.
9. Returns and defects
Because the Products are personalised and made to order, we do not accept returns for change of mind.
We will replace or refund Products that are defective, that do not match the approved proof, or that are damaged in transit. Tell us within 14 days of delivery, with the batch reference and photographs where relevant.
10. Product information and safety
Yak chews are a hard natural chew. They are a treat, not a complete food, and are not a veterinary medicine or therapeutic product. Chews should be given under supervision, matched to the dog's size and chewing strength, and removed when worn down to a swallowable piece.
Weights, chew times and dog weight ranges are typical values for a natural product and vary between individual chews. Ingredient, allergen and nutritional information is provided by the manufacturer; you are responsible for any additional labelling your own jurisdiction requires for resale.
11. Resale by you
You may resell the Products in your practice and through your own online channels. You may not remove, obscure or alter wrapper information, repackage the Products, or present them as manufactured by your practice rather than made for it.
12. Intellectual property
You keep all rights in your clinic name and logo. You grant us a non-exclusive licence to use them for the purpose of producing, proofing and packaging your order, and — only with your prior written consent — to show the finished wrapper as an example of our work.
We keep all rights in the wrapper design, artwork templates, product photography and the contents of this website.
13. Liability
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, our total liability arising out of any order is limited to the price paid for that order, and we are not liable for loss of profit, loss of business, or indirect or consequential loss.
14. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including weather and seasonal conditions affecting milk supply, transport disruption, customs delays, and acts of government. Where such an event occurs we will tell you promptly and agree a revised production date.
15. Governing law
These terms and any dispute arising from them are governed by the laws of the jurisdiction in which we are established, and the courts of that jurisdiction have exclusive jurisdiction. The operating entity and jurisdiction will be named here before launch.
